Horse Legal Issue NEED ALOT OF ANSWERS!!!?
Okay I had a woman boarding at my barn and she has already got behind on her board. She owes me $800 and yes there was a boarding contract but she didn’t sign it. She wants to come pick the horse up soon and she doesn’t want to pay the money. I was going to keep the horse until she pays and just keep charging for board until it is all payed up. But I was thinking can I not just take over ownership of the horse? I don’t know what to do so any advice or past experience stories would be very helpful. Thanks
I’m pretty sure you can’t keep the horse unless she agrees to the transfer of ownership.
I think you have to apply for a court order and if the debt isn’t paid in a set time the horse is sold to cover the debt and court costs.
What you don’t do is let the horse leave till she has settled her bill.
Sooner you bring it to a head the more the horse is worth and the less costs you yourself will incur. The horse is a financial asset of no determined value unless it is sold.
